About these terms
These terms govern your use of sugarloafdigital.com.au and, where you do not have a separate signed agreement, the basis on which SugarLoaf Digital Pty Ltd (ABN 90 657 585 370) provides its services. Where you do have a signed service agreement, that agreement prevails over these terms to the extent of any inconsistency.
Nothing in these terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded.
What we do and do not do
SugarLoaf Digital is a marketing company. We build and operate websites and Google Business Profiles, generate enquiries from them, and provide marketing services including local SEO, website development and call answering.
We do not perform trade work of any kind. We do not quote jobs, attend sites, supervise work, inspect work or hold trade licences. Where an enquiry generated by one of our websites leads to work being performed, the contract is between the consumer and the trade business, and that business alone is responsible for quoting, workmanship, compliance, licensing, insurance and any warranty.
Lead services
Billable leads. Unless your agreement says otherwise, a billable lead is an answered telephone call exceeding ninety seconds from within your territory concerning a service you have told us you offer, or a submitted form containing genuine contact details and a description of a job within your territory for a service you offer.
Not billable. Wrong numbers, hang-ups, automated or robocalls, sales and marketing calls, job applicants, existing customers of yours calling your tracking number, enquiries from outside your defined postcodes, and enquiries for services you have told us you do not provide.
Disputes. Raise a disputed lead within the window stated in your agreement, with a reason. Leads falling outside the billable definition are credited. Call recordings are retained for twelve months as described in the privacy policy.
Territory. Territories are defined by postcode and by trade and are exclusive to one business for the duration of the engagement. On cancellation the territory may be licensed to another business without notice to you.
No guarantee of volume. We do not guarantee a number of leads, a conversion rate, a ranking position, or any revenue outcome. Search demand varies with season, weather and local conditions and is outside our control. The circumstances in which we consider the service unsuitable are published on when pay-per-lead is the wrong model.
Ownership of assets
Under lead generation services, the domains, websites, content and Google Business Profiles that generate enquiries are owned by SugarLoaf Digital and remain our property. You are purchasing enquiries, not the underlying asset, and you acquire no interest in it. This is explained further on why rank-and-rent works.
Under local SEO and website development engagements, assets built in your name — domain, hosting, site and profile — belong to you from the outset and remain yours on termination, subject to payment of amounts due.
Billing and cancellation
Lead services are invoiced in arrears for leads delivered in the period. Other services are invoiced as set out in your agreement. Amounts are payable by the due date on the invoice.
Engagements run month to month unless your agreement states otherwise. Either party may cancel on thirty days written notice to info@sugarloafdigital.com.au. You remain liable for services and leads already delivered. We may suspend services for accounts overdue beyond the period stated in your agreement.
Website use

Liability
To the extent permitted by law, our liability for any claim arising from our services is limited to resupplying the services or refunding the amount you paid for the services giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profit, loss of business opportunity or loss of data.
We are not liable for any act or omission of a trade business that receives an enquiry, or for any work performed as a result of an enquiry.
Governing law
These terms are governed by the laws of Western Australia and the parties submit to the non-exclusive jurisdiction of the courts of that state.

Frequently asked questions
Do these terms replace my service agreement?
No. If you have signed a separate service agreement with us, that document governs your engagement and prevails over anything here if the two conflict. These terms cover use of this website and set out the general basis on which our services are provided to everyone else.
Am I responsible for the work done on a job you referred?
Yes. The trade business performing the work is solely responsible for it, including quoting, workmanship, licensing, insurance and warranty. We generate and pass on enquiries. We do not perform, supervise, inspect or guarantee any trade work, and we are not a party to the contract between the customer and the tradesperson.
How do I cancel?
Give notice by email to info@sugarloafdigital.com.au. Lead services run month to month with thirty days notice, after which leads from your territory stop and may be licensed to another business. You remain liable for leads already delivered in the current period.
What if I dispute a lead?
Flag it in the client portal within the dispute window stated in your agreement, with the reason. If it falls outside the billable lead definition below, it is credited. Call recordings are attached to every billed call so the decision is checkable rather than a matter of trust.
